Enforcing Court judgments

Druces’ Litigation & Dispute Resolution team works closely with clients to guide them through the litigation process from start to end. In many cases, successfully obtaining a judgment is not the last step as it does not guarantee payment of the judgment debt. In many cases it is necessary to take steps to protect assets from dissipation by the judgment debtor or to enforce judgment against an unsuccessful litigant or to initiate insolvency processes.

We are able to advise on the most appropriate method of enforcement suitable to each case. We have experience of enforcing judgment debts by means of charging orders through which the debt can be secured against the debtor’s property, third party debt orders against the debtor’s bank accounts, attachment of earnings orders, warrants for execution against goods and freezing orders to protect against dissipation. We also advise on insolvency processes in circumstances where debtors are unable to pay, including corporate creditors’ winding up orders and personal bankruptcy.
