Our Litigation and Private Client teams work together to advise beneficiaries or trustees with disputes in relation to existing trusts. Problems are often caused by trustees failing to fulfil their duties or failing to deal with matters on time or at all. Issues can also arise where two or more trustees have fallen out and can no longer agree on decisions concerning the trust. Contentious probate work is on the increase, with a number of factors such as the increase in house prices, badly drafted home-made wills, and complicated family relationships making disputes more likely to arise. We advise clients who have been excluded under a Will of their options and act for those administering estates where a claim has been made against it. An independent administrator may also be required in a probate dispute and this is a service we can provide.
